The Medical Conscience Clause in the Face of the Possibilities of Modern Medicine

Abstract

The category of conscience in medicine plays a special role. Doctors’ actions are, by definition, focused on the good of the patient. However, due to the specificity of the profession, they often face the dilemma of choosing between their own beliefs and the patient’s interests, their expectations, and legal possibilities and organizational, economic and technical limitations. The above situations may have a destructive impact on the doctor-patient relationship and disturb their mutual trust, which is one of the basis for effective treatment. The aim of the work is to attempt to indicate the contemporary sources of doctors’ dilemmas. To achieve this goal, an analysis of currently applicable legal regulations and deontological norms guaranteeing doctors’ freedom of conscience was also carried out. The work identifies the main sources of doctors’ moral dilemmas, seeing them in some solutions obtained thanks to scientific and technological development (not always acceptable to everyone), juridization, bureaucracy and economization of health care. Postulates were presented to take action to limit the sources that generate moral dilemmas for doctors, for example by ensuring the stability of the law or the principles of financing facilities providing medical services, as well as balancing the patient’s interests and the desire for profit. Nevertheless, this task seems extremely difficult due to the need for systemic changes in health care.
