PRINCIPIUM AEQUITATIS PROCESSUUM AND THE RULES OF PUBLIC PROCUREMENT

Abstract

Public procurement rules should ensure the contracting authority’s interests and create trust in business transactions. The study used the hypothetical-deductive method and focused on the provisions of the Public Procurement Law, jurisprudence and doctrine. It was found that the principles of awarding public contracts in the scope of guarantees of impartiality and objectivity can raise discretional interpretation. There is the need to clarify the case of combining the function of a member of the tender committee with the function of the person to whom the head of the awarding entity entrusted the performance of the activities reserved to him/her as indicated, as well as to define the obligations in the scope of submitting statements on impartiality. The precise interpretation will allow avoiding irregularity in implementing the state’s purchasing policy.
