Abstract

Artnapping is generally understood as “abduction” of a work of art in order to obtain a ransom for its return. This phenomenon is rather poorly researched scientifically and it is rather rarely recognised, prosecuted and judged in the practice of criminal procedure bodies and institutions. The knowledge about artnapping and its perpetrators is currently in fact fragmentary. In general, the items which are the object of theft and which are “hostages” of those who formulate financial demands in exchange for the return of such items are works of painting. Paintings, which are valuable in cultural and material dimensions, are difficult to place on the art market, even on its illegal territory. Thus, the demand for ransom for the return of a previously stolen work of art could appear in the space of socially negative phenomena as a natural consequence of the lack of possibility to sell such a work, both on the legal and illegal art market. Artnapping seems to be a criminal phenomenon which is gaining popularity and is characterized by significant development potential, especially in the world of organized crime. The assumed profitability of artnapping can be tempting, and the risks accompanying the material gain from this criminal activity can be treated as costs which, in criminal (economically rational) calculations, may simply pay off.
