The Extent of State Involvement in Education: Selected Legal Issues

Abstract

This article examines the influence of the state and its institutions on education (schooling). The first part refers to the historical significance of the Commission of National Education, which, alongside the Constitution of 3 May, represents one of the most important achievements of the Polish Enlightenment. The key features of the Commission as the foremost state educational institution of its time are outlined, with particular attention paid to its position within the state structure and the scope of its reforms. The second part highlights the distinct nature of the modern state, where constitutional principles prevail, establishing the right to education as a fundamental human right. The state bears responsibility for realising these rights, fulfilling public tasks through governmental administration and local self-government, with the participation of non-public entities.
