The Pattern of the Social Role of Witness in Civil Proceedings As an Element of Socialisation of Children and Young People from the Perspective of a Trial Lawyer

The authors present the model of a witness in civil proceedings as one of the social roles that should be educated during the process of socialisation of children and young people. In the course of education in the family and in school, a young person is socialised, who acquires the skills to play social roles in relations with others (marriage, parenting, being a member of a specific peer community, etc.), as well as in relations with state authorities (including judicial authorities). One such role that most citizens will face due to the universality of civil-law social relations is the role of a witness in civil proceedings. The paper identifies the essential elements that make it possible to recognise that this role is performed correctly by the person concerned. At the same time, when considering on the basis of the fundamental civic duty expressed in the Constitution, which is the observance of the law, it was pointed out which aspects of witness status should be particularly emphasised during the socialisation of the younger generation. In that regard, the obligation to appear in the court, the obligation to make a promise and the obligation to give evidence were indicated in this regard.
