Determinants of Serving a Sentence of Imprisonment by Inmates, Women and Men with Intellectual Disabilities

Abstract

The perception of the world and thus the needs of people with disabilities differ significantly from the rest of society. This task also applies to disabled people serving a prison sentence. This was noticed by the Ombudsman, prof. I. Lipowicz in an open letter addressed to the General Director of the PS. It is therefore worth considering more broadly the determinants of serving a prison sentence by people with disabilities. The purpose of this article is to undertake this reflection. Based on theoretical considerations and research conducted using the biographical method, an attempt was made to determine these determinants by talking to disabled prisons. First of all, PS officers and educators in prisons must take into account that people with disabilities: 1) they function intellectually below normal; 2) they have considerable difficulty performing activities that might be considered normal.

These and other factors must be taken into account when working with persons with disabilities serving a prison sentence. Among the determinants, biological theories of crime will be discussed, because there may still be people among the PS officers and educators who will be based on such views. This, in turn, leads to a specific type of conduct towards this category of prisoners. It is worth considering whether the penalty of imprisonment against the disabled contributes to their social rehabilitation. Is it therefore necessary to engage in other types of activities that will allow them to be reintegrated into society?
