The aim of the article is to present the social situation of women who are mothers and bring up children while serving a prison sentence. The reflection begins with a brief reflection on the way in which mothers raising a child serve their sentences. It turns out that many of the changes were introduced only after World War II. Of great importance was the activity of Maria Łopatkowa, who created a theory called the pedagogy of the heart. She noted that the first five years of a child's life are important in order to raise a child properly. Then the emotional contact between the child and the mother counts. For this reason, M. Lopatkowa instilled the initiative to establish the Home of Mother and Child. It creates the possibility of bringing up a child in conditions of deprivation of liberty. Political changes in Poland after 1989 made it necessary to respect the principles of human rights. In addition, the Constitution of 1997 created the necessity of taking care of motherhood. The Penal Executive Code of 1999 created the possibility of raising a child in conditions of imprisonment. The social situation that prevails in the Home of Mother and Child is possible to reconstruct on the basis of research that was carried out in 2018. In the course of the research, the method of qualitative research in the form of an interview was used. Thanks to this, it became possible to get to know the subjective opinions of mothers serving a prison sentence in the Home of Mother and Child. The article quotes the statements of respondents who assessed the social situation in the Mother's Home in terms of material, living, relations with other prisoners and also in terms of conditions of raising children. In addition, the opinion of prisoners on rehabilitation was quoted. This is important because rehabilitation is one of the foundations of the Mother and Child Home. Getting to know the subjective opinion of prisoners on this subject is an important opinion about the social situation in the Mother's Home. The house in Krzywaniec is an example of the social situation that concerns prisoned women raising children.
